Our process
From first call to funding
Our review is sequenced to protect privilege, respect your time and reach a clear answer. You know where the matter stands at every stage.
Initial overview
Indicative timing: Days 1 to 5
You send a concise, nonprivileged summary: parties, forum, claim theory, damages basis, counsel and capital need. We confirm preliminary fit or explain why the matter falls outside the mandate.
Confidentiality framework
Indicative timing: Weeks 1 to 2
If the matter fits, we agree on an NDA or common-interest arrangement with you and counsel before requesting pleadings, key documents or damages work.
Diligence
Indicative timing: Weeks 2 to 6
We review merits, damages, collectability, budget, duration and counsel together, using internal analysis and, where needed, outside experts under the same confidentiality terms.
Term sheet
Indicative timing: Weeks 4 to 8
Approved matters receive a term sheet setting out commitment size, drawdown mechanics, return structure, priority of proceeds and remaining conditions.
Funding and monitoring
Indicative timing: At closing and after
We document the financing, fund according to the agreed schedule and receive regular reporting. Litigation strategy and settlement decisions remain with the client and counsel.
Timing is indicative and depends on complexity, document readiness, counsel responsiveness, conflicts and structure. An initial submission does not create a financing commitment.
Questions
Before you submit
What should the initial overview include?
The parties, the forum and stage, a short description of the claim, the basis for damages, the identity of counsel and the capital you are seeking. Two to three pages is enough. Leave out privileged analysis.
Does LOFFCO control the case?
No. The client and its counsel keep control of strategy and settlement. Financing agreements say what we get told and when. They give us no vote on how the case is run.
How is confidentiality protected?
We request substantive materials only after an NDA or common-interest agreement is in place, limit access to the review team, and exchange documents through a controlled data room.
What happens if the matter is declined?
We tell you promptly. Where possible, we explain the reason, such as claim size, collectability or stage, so you can decide on next steps.
How long does the process take?
Timing depends on complexity, the readiness of documents and counsel responsiveness. The ranges above are indicative. Urgent matters can be prioritized when the file is ready.
Confidential case review
Start with a nonprivileged overview
Send a short summary of the dispute, the parties and the capital need. We answer every submission within five business days. Substantive materials come later, once a confidentiality framework is in place.
